Terms of use

1. Provider and scope

The provider of the applications PDNotes and PDNotes Education is P&D Abend Media, Bungerstr. 1, 66640 Namborn, Germany (“we”).

These terms govern the use of both applications. If you obtain the app through the App Store or Google Play, that provider's terms apply in addition.

2. What PDNotes is — and is not

PDNotes is a program for handwritten notes and for working on PDF files. It runs on your device.

PDNotes is not a service. That means:

• We store no notes for you.
• We provide no storage space.
• We transfer no content between devices or people.
• There is nothing that could go down and make your notes unreadable.

If you sync your devices through a cloud folder, the operator of that storage is your counterpart for that service, not us.

3. No account

No sign-up is required. We issue no credentials and keep no user administration. You therefore cannot “cancel” with us — you simply delete the app.

4. Your notes are yours

We acquire no rights whatsoever in anything you write, draw or import in PDNotes. We do not see it, do not store it, do not analyse it.

Your notes are files in a folder you determine. They remain there even if you delete the app or we one day stop developing it. A complete export to open formats is possible at any time.

5. Free edition and full version

The free edition is permanently free, without watermarks and without advertising. All tools, PDF import and export are available without restriction. The only limit is the number of notebooks, capped at three.

The full version lifts that limit. It is bought once — there is no subscription. Syncing between your devices through your own cloud folder is included and costs nothing extra, because it costs us nothing.

Even without a purchase, notebooks you have already created remain fully editable. We do not lock anything retroactively.

6. Our pledge

Your notes stay editable. Always. Even if you never pay again.

From this follows, bindingly:

1. A purchased version remains usable permanently.
2. There will never be a major version that demands a repurchase.
3. Notes remain readable and editable without an account and without an internet connection.
4. There is no subscription for core functionality.
5. A complete export to an open format is always possible.

7. Right of withdrawal

The purchase is concluded between you and Apple or Google. Their terms govern withdrawal and refunds, and they handle both. If a purchase is refunded, the unlock ends — your notes are unaffected.

8. PDNotes Education

The school edition is the same application, but is obtained as a separate paid app and is fully unlocked from the start. It additionally includes the connection to Apple's Schoolwork.

If a school or school authority procures the app, the terms of Apple's respective procurement programme apply. We receive no data about teachers or learners in the process.

9. Your obligations

You undertake

• not to use the app for unlawful purposes,
• not to infringe third-party copyright, for example when importing PDF files,
• not to circumvent protection mechanisms and not to modify the app in order to obtain the full version without purchase.

10. Backing up your data

You are responsible for backups. Since we store nothing of yours, we can restore nothing. Back up your library folder the way you back up other important files.

11. Transfer to your computer

At your request, PDNotes can start a temporary transfer service on your device so that a computer on the same Wi-Fi can back up your notebooks. This feature runs without any servers of ours; we provide it as a tool but do not operate a service behind it.

You decide when the service runs, and you only share the security code with devices you trust. Only use the feature on networks you trust — we advise against foreign, public or guest networks.

Uploading files to your device must be switched on separately. Received files only become part of your library once you confirm this on the device. You are responsible for the content you transfer.

If your device is managed — by a school or an employer, for example — that management can switch this feature off. It then appears in the settings with a corresponding note, but cannot be started.

12. Availability and further development

The app runs on your device without any involvement from us. We owe no particular availability, because there is no service that would need to be available.

We aim to maintain and develop the app but owe no particular future features. Should we discontinue development, the last version you received remains usable and export remains possible.

13. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence we are liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical for this type of contract.

Liability under the German Product Liability Act remains unaffected. Any further liability is excluded.

In particular, we are not liable for loss of data to the extent that such loss could have been avoided by a reasonable backup on your part.

14. Changes to these terms

We may change these terms if the app changes or the legal situation requires it. The current version is available in the app under Settings → Legal. Changes never affect the pledge in section 6.

15. Final provisions

German law applies. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

Should any provision be invalid, the remainder of the contract stays valid.
